Niles man jailed after pointing gun at relative

A Niles man who pulled a gun out of a diaper bag and pointed it at his father- in-law was sentenced to 30 days in jail Tuesday in Berrien County Trial Court in Niles.

Andrew David Clark, 29, pleaded guilty earlier to one felony count of attempted assault with a dangerous weapon and one misdemeanor count of reckless use of a firearm.

The incident occurred Feb. 8 in the 1700 block of Niles-Buchanan Road in Niles.

According to court documents, the victim told police that he was arguing with his daughter (Clark’s wife) when Clark became involved and pointed a gun at him.

“I was in fear for my life,” the victim told police.

Clark then fired a shot into the ground before leaving in a vehicle with his wife and three children, who were 8, 5 and 10 months old at the time, according to court documents.

Prosecutor Amy Byrd said she found it troubling that Clark had kept a loaded handgun in a diaper bag and that one of the children could have gotten the gun.

Clark’s defense attorney said his client normally does not keep a gun in the diaper bag and was just using the bag to transport the firearm from the home to the vehicle.

Clark apologized for his actions and said it was an accident.

Judge Dennis Wiley said pointing a gun at someone and then firing it into the ground is not an accident.

“Those are deliberate acts,” said Wiley before sentencing Clark to two years on probation and 30 days in the Berrien County Jail.

Clark must also surrender the weapon and pay $1,888 in fines and court costs.
