Driver imprisoned for running over pedestrian

An Indiana man who ran over another man with a sports utility vehicle in Buchanan after a domestic dispute in July will spend at least two years in prison.

Ted Paul Jones, 53, of New Carlisle, Indiana, was sentenced Monday in Berrien County Trial Court to 24 to 48 months in prison on one felony count of assault with a dangerous weapon.

According to court documents, Jones ran over the victim on West Chicago Road near Clark Street just after midnight July 30.

The victim told police that shortly before being struck by the vehicle, he had helped rescue his girlfriend who reported being assaulted by Jones, who is also her uncle.

Witnesses told police the SUV accelerated before hitting the victim, causing him to flip over the hood and land violently on the ground.

“You are darn lucky you did not kill him,” said Judge Dennis Wiley.

Assistant Prosecutor Amy Byrd said Jones was out on parole from Wisconsin when he committed the offense.

Wiley said the time could be served in any penal institution as Jones has another court matter pending out of state.

Also Monday:

• Austin Blake Holdren, 24, of Buchanan, was sentenced to 150 days in jail and two years on probation on one court of assault with a dangerous weapon. According to court documents, Holdren fired a gun at three juveniles around 2:30 a.m. July 25 in the 300 block of North Red Bud Trail in Buchanan. Holdren’s attorney, James Jesse, said it is possible that the victims exaggerated when telling police Holdren shot at them. He said it is more likely Holdren shot into the air. Holdren was also ordered to relinquish the weapon and perform 60 hours of community service.

• Julie Ann Potate, 42, of Buchanan, was sentenced to 15 days in jail on one count of lying to a peace officer. She was also ordered to repay the Buchanan Police Department for the time it lost chasing down the false lead she had produced.

• Janie Claudia Esquivel, 38, of Holland, was sentenced to 150 days in jail and three years on probation on one count of first-degree retail fraud. According to court documents, Esquivel loaded a cart with more than $400 in items and left the Niles Wal-Mart without paying. Esquivel was banned from working at or going to any retail store as a condition of probation.

• Marion Perry, 17, of Benton Harbor, was sentenced to 20 months in prison on one count of assaulting a prison employee.
