Sixth OWI lands Niles man in prison

CASSOPOLIS — A Niles man convicted for the sixth time of drunken driving will not be able to get behind the wheel of a motor vehicle for awhile as he will spend nearly two years in prison.

Frederick Roos, 50, received a minimum sentence of 23 months in the Michigan Department of Corrections Friday in Cass County Circuit Court.

Judge Michael Dodge said Roos had a blood alcohol level of 0.23 — nearly three times the legal limit — on Aug. 28 when he crossed the center line and hit another vehicle head on on US Highway 12 near the intersection of Fir Road in Niles.

“The fact that he didn’t kill anyone is amazing,” said Assistant Prosecutor Tiffiny Vohwinkle, adding that Roos had five previous convictions for drunken driving.

Roos pleaded guilty Sept. 11 to one count of felony operating while intoxicated as a habitual offender and one count of failure to stop at the scene of an accident.

Sentencing guidelines were set at 5 to 23 months.

Dodge said the driver of the other vehicle walked away without any injuries, but his vehicle sustained more than $4,000 in damages — money Roos was ordered to repay.

He gets credit for 58 days already served.

Also Friday, 27-year-old Quantrell Mallett, of Dowagiac, was sentenced to 30 months in prison on a charge of domestic violence as a habitual offender. Dodge said Mallett choked, hit and pointed a gun at his girlfriend during a domestic incident on James Street in Dowagiac Aug. 12.

Mallett asked Dodge for leniency, saying he didn’t want to be away from his six children.

“I am not a street thug. I’m not a street dude. I’m a father,” Mallett told the judge.

Dodge sympathized with Mallett’s desire to be with his children, but said there wasn’t a good enough reason to justify deviating from the sentencing guideline of 22 to 57 months.

Mallett pleaded guilty Sept. 16 to one count of domestic violence, one count of possession of a firearm by a felon and one count of delivery of marijuana. All stemmed from the same incident.

Also Friday:

• Dylan Griffin, 18, of Mishawaka, was sentenced to one year of probation on one count of conspiracy breaking and entering a building with intent. Dodge said Griffin and two others were caught trying to steal a washer/dryer from a residence on Gumwood Road in Niles June 22. Griffin was assigned to the Holmes Youthful Trainee Act, meaning his conviction will not be entered if he successfully completes probation.

• Alyssa West, 18, of Dowagiac, received two years probation on one count of attempted malicious destruction of property $1,000 to $20,000. Dodge said West spray painted obscenities on another person’s home on Twin Shores Drive in Dowagiac in May. West was assigned to the Holmes Youthful Trainee Act.

• Michael Jordan, 32, of White Pigeon, received two years probation on one count of larceny in a building and one count of possession of Vicodin. Dodge said Jordan stole money and pills from the owner of a farm where he was employed as a farm hand in July in Three Rivers.

• Adam Correa, 23, of South Bend, Ind., was sentenced to 120 days in the Cass County Jail on one count of resisting and obstructing police as a habitual offender. Dodge said Correa was drunk when he kicked a police officer who was trying to arrest him after a domestic disturbance at his girlfriend’s home on Indian Lake Road in Niles Aug. 21.

• Michael Reeves, 21, of Dowagiac, received a two-year probation sentence on one count of attempted conspiracy to commit larceny $1,000 to $20,000. Dodge said Reeves and a co-defendant stole an air conditioner from a Dowagiac business in August.

• Rebecca Pontius, 26, of Elkhart received an 18-month probation sentence on one count of larceny in a building. Dodge said Pontius spent money she took from a wallet found in the women’s restroom at Four Winds Casino in Dowagiac in September.
