Miller charged after 16-year-old comes forward in second case

Martell Miller, 17, was bound over for trial at a pre-exam hearing at Berrien County Trial Court in Niles Tuesday.
Miller has been charged with one count of third-degree criminal sexual conduct and another count of fourth-degree criminal sexual conduct for allegedly sexually assaulting a 16-year-old female at Niles High School in February.
The girl took the stand Tuesday, alleging that after school on Feb. 11 Miller twice tried to kiss her and when she resisted, he grabbed her by the arm and touched her breast. She said Miller then put her hand down the girl’s pants and attempted to penetrate her vagina with his finger.
The girl said she knew Miller through an ex-boyfriend but wasn’t good friends with Miller.
In cross-examination by Miller’s attorney Shannon Sible, the girl was asked if she screamed for help when it happened. She said she raised her voice but didn’t yell. Sible also asked her why she didn’t tell school officials about the incident right away.
“I was scared,” the girl said.
She notified school administration of the incident after news broke about the video sex scandal involving Miller and four other Niles teens in May.
“It was all over the news … I had to tell somebody,” she said.
Sible referenced some Facebook messages between Miller and the girl from after the alleged incident. One of the messages the girl apparently sent Miller was to not tell others at school about what happened.
Sible read from the alleged message: “I don’t want to be another Niles ho.”
“You said he (Miller) attacked you. Why would people think you were a ho if you were attacked?” Sible asked the girl.
Before she could answer, he asked if she “fooled around” and “made out” with Miller the night of the incident.
“No, I did not,” the girl said, fighting back tears.
Sible also questioned why the girl didn’t come forward about Miller allegedly touching her breast until Monday.
“It was the least of my worries,” she said.
She told authorities Monday when she “realized it wasn’t in the report.”
Judge Scott Schofield scheduled the trial for Nov. 29 through Dec. 1 with a case conference slated for Oct. 21 and a status conference Nov. 18.
Miller was already facing five charges in the sex video case — two counts of first-degree CSC, two counts of third-degree CSC and a count of extortion.
Miller, along with Parnell Martin, Leon Murphy and Martise Washington, were allegedly involved in a scheme to blackmail an underage female into having sex with them in March. They are accused of threatening to post a video recording of her having sex with one of them on Facebook if she didn’t comply.
Trey Nichols, another Niles teen involved in the case, is facing child pornography charges for allegedly producing the recording.
Trials in that case are scheduled for mid-October for Martin, Miller, Nichols and Washington. Murphy, meanwhile, accepted a plea bargain in May, pleading guilty to a count of third-degree CSC and a count of possession of child pornography. He will testify against his co-defendants as part of the deal.
