CASSOPOLIS — A Dowagiac man who resisted police during an incident last May in Dowagiac and who then represented himself at a January trial has been sentenced to prison.

Robert Allen Scott, Jr., 33, of Dowagiac, was convicted of six felony counts and was sentenced to 46 months to 20 years in prison with credit for no days served on four of the counts and a consecutive two years with credit for 294 days served on the other two counts. He must pay $3,388 in fines and costs.

The four counts where he received the 46 months sentences were possession of a weapon by a prohibited person, possession of ammunition by a prohibited person, carrying a concealed weapon and larceny of a weapon-all as a habitual offender. He was also convicted of two counts of use of a firearm in the commission of a felony for the consecutive two year sentences.

The incident occurred May 4 on Third Avenue in Dowagiac.

Assistant Prosecutor Jason Ronning said that Scott doesn’t think the rules apply to him, noting that Scott trespassed at a gas station and stole a family member’s gun when he knew he couldn’t have one. Scott also struck his attorney in the face during the January trial.

      Scott continued to defend his innocence and his actions both that day and during the trial.

      “The jury found you guilty,” said Cass County Circuit Court Judge Mark Herman. “They made their determination, I know you disagree with it … You have an extensive assaultive background and obviously you have no intention of changing your ways so we have to protect society by keeping you out of the community.”

      In other sentencings:

• Samuel Hernandez-Garcia, 44, of Berrien Springs, pleaded guilty to third offense drunk driving and was given an 11 month delayed sentence of credit for three days served, $2,048 in fines and costs and $345 in restitution. He can reduce the charge to second offense drunk driving if he completes the delayed sentence probation. The incident occurred Sept. 8 on Crystal Springs Street outside of Dowagiac.
• Kejuan Shaquan Clark, 20, of Halstead Street in Dowagiac, pleaded guilty to resisting and obstructing police and was sentenced to 270 days in jail with credit for 126 days served and $1,548 in fines and costs. He can serve the jail term in any correctional facility. The incident occurred Oct.19 in Dowagiac.
• Timothy Patrick James, 37, of Buchanan, pleaded guilty to attempted resisting and obstructing police and was sentenced to credit for 208 days served and $198 in fines and costs. The incident occurred Oct. 19 when he fled from police. He is currently serving a prison term from a Berrien County conviction for fleeing and eluding police and other charges from this same incident.
