NILES — A Niles man who got into a dispute with a neighbor was sentenced to jail Monday in Berrien County Trial Court at the Niles courthouse.

Collinsworth

Kyle Paul Collinsworth, 27, of Niles, pleaded guilty to aggravated assault and was sentenced to five months in jail with credit for 15 days already served. He must pay $125 in fines and costs.

The incident occurred Aug. 8, 2024 in Niles. Collinsworth had originally been charged with assault with a dangerous weapon, a brick.

The victim spoke before sentencing and said that Collinsworth and his friends had been trying to intimidate him and others in the neighborhood.

“I’m luck to be alive,” he said. “If didn’t have mace to spray at him, he would have killed me.”

Defense attorney Carri Briseno said the assault was the culmination of problems and grievances in the neighborhood that began last spring. She said that Collinsworth told her that he had also been harassed and was being chased by the victim at the time of this incident.

She said Collinsworth is currently getting counseling at Riverwood. For his part, Collinsworth apologized but said that he threw a brick after being chased by the victim.

“Based on your history, I don’t believe that probation is a possibility,” Berrien County Trial Judge Gordon Hosbein said. “This was a serious offense, your attorney got you a good deal.”

Collinsworth previously served 18 months in prison from 2019 convictions for possession of cocaine/narcotics and interfering with electronic communications. He also received a 13 month prison sentence from a 2014 conviction for receiving, concealing or possession of a stolen motor vehicle.
