Victim was shot in the neck after an argument

The 17-year-old accused of shooting a 33-year-old in the neck Sunday has been arraigned and charged with an array of crimes after an argument escalated into violence.

Dakota Matthew Stanley was charged with assault with intent to murder, assault with intent to do great bodily harm, assault with a dangerous weapon and three counts of felony firearms Monday, according to the Cass County Sheriff’s Office.

Cass County 911 received an emergency call from a residence at 71042 Kline Road in Milton Township indicating that a man, Thomas Lewallan, 33, of St. Joseph, had been shot.

Officers arrived on scene and found Lewallen lying on the porch with a single gunshot wound.

Officers located the suspect in the shooting at the home and detained him.

Lewallen was transported to South Bend Memorial Hospital for treatment.

Officers say initial investigation shows that an argument escalated between Lewallen and his wife, Carolyn, and Stanley intervened. The 17-year-old shot Lewallen with a handgun he had in his possession.

Police have determined that alcohol played a factor in the incident.

Stanley was lodged at the Cass County Jail.
