Missourian convicted for sexual assault on 8-year-old

A 39-year-old Missourian who forced an 8-year-old girl to perform multiple sex acts upon him and his 27-year-old wife was found guilty by jury of five counts of criminal sexual conduct Wednesday in Cass County.

The jury returned guilty verdicts for the following charges against the defendant, Galen Mclean:

• One count of conspiracy to commit first-degree criminal sexual conduct (punishable by life or any term of years in prison)

• Three counts of first-degree criminal sexual conduct (punishable by life or any term of years in prison)

• One count of ailure to comply with Sex Offender Registration Act (punishable by four years in prison and/or a $2,000 fine)

Testimony at trial from witnesses, including the little girl, the Sexual Assault Nurse Examiner Angie Mann, and other witnesses, the two adults pperform several sexual acts on them.

“This little girl was violated in the most disgraceful way and then forced to perform appalling acts upon a married couple tasked with her protection,” said Cass County Prosecutor Victor Fitz. “There is no quarter for such depraved behavior in our society.”

Fitz also praised Detective Kristen Dailey and the Cass County Sheriff’s Department for their investigation of the matter.

The evidence required deliberations of approximately 15 minutes.

Because of the defendant’s prior Missouri conviction for a sexual offense on a child under the age of 13, his Michigan statutory sentence is expected to be mandatory life without parole.

The third grade victim was intermittently staying with Galen Mclean and his wife at their 50140 Magician Lake Road home in Silver Creek Township, in 2014 and 2015 while the girl’s mother dealt with various issues.  Witnesses at trial established that it was during this time that the criminal acts were performed upon her.

The victim was not related to the defendant or his wife.

Some time after the crimes, the defendant and his wife left Michigan for the state of Missouri where they were eventually located and extradited back to Michigan by Cass County law enforcement.

Cass County Assistant Prosecutor Tiffiny Vohwinkle, who tried the case, described during closing arguments that McLean used the child victim for his own sexual perversions.

The decision was rendered at approximately 3:10 p.m.  The Defendant remained expressionless during the reading of the verdict.

Galen McLean was also convicted Wednesday of failure to register as a sex offender. This resulted from his 2001 Missouri conviction for sexual misconduct with a child, a first-degree felony.  He also is charged with being a habitual offender.

Other priors include Missouri convictions for forgery in 1997 and burglary in 1995.

Galen McLean is set for sentencing at 8:30 a.m. July 15, in front of Cass County Circuit Judge Michael Dodge.

The Mclean’s wife faces similar charges and is set for jury trial 9 a.m. June 14, 2016, in Cass County Circuit Court.
