Jury convicts Benton Harbor man for series of sexual assaults

A Benton Harbor man has been found guilty of three counts of sexual assault and will face a minimum of 25 years in prison, according to Berrien County Prosecutor Michael Sepic.

The jury returned guilty verdicts for three assaults Marcus Antuane Stewart committed, which occurred in separate incidents between July 29 and Aug. 31, 2015, in Benton Harbor.

Stewart, 42, was convicted on the following charges:

• In the July 29, 2015, incident on North Hull Avenue in Benton Harbor: Criminal sexual conduct in the first degree, a life maximum or any term of years; and assault by strangulation, a 10-year maximum.

• In the Aug. 17, 2015, incident on Ogden Avenue in Benton Harbor: Criminal sexual conduct in the first degree, a life maximum or any term of years; and assault by strangulation, a

10-year maximum.

• In the Aug. 31, 2015, incident on Lincoln Street in Benton Harbor: Criminal sexual conduct in the first degree, a life maximum or any term of years; home invasion in the first degree, a 20-year maximum; attempted assault by strangulation, a five-year maximum and interfering with a telecommunications device, a two-year maximum.

Due to the nature of his prior record, Stewart faces a minimum sentence of 25 years at his sentencing June 13, 2016, according to Sepic.

Chief Assistant Prosecutor Jennifer Smith presented the people’s case in the courtroom of Judge Donna Howard that started Tuesday. Ernest White III was Stewart’s defense counsel. The jury deliberated a little more than one hour before returning its verdict.

The case was investigated by the Benton Harbor Department of Public Safety, in conjunction with the Michigan State Police Major Case Unit.
