Medical marijuana clinic owner facing drug charges

Sean Erhard, 42, owner and operator of the Your 3M Medical Marijuana Center, 3134 Niles Ave., St. Joseph Township is facing drug charges, Berrien County Prosecuting Attorney Art Cotter announced Wednesday.

Erhard is charged with four counts of delivery of marijuana 2nd offense (an eight-year felony) and four counts of the illegal sale of medical marijuana 2nd offense (a four-year felony), arising out of drug sales that occurred at the Your 3M Medical Marijuana Center.

He is also charged with three counts of delivery of marijuana 2nd offense and three counts of the illegal sale of medical marijuana 2nd offense, arising out of drug sales that allegedly occurred at his residence, located at 10415 Range Line Rd., Berrien Township.

The drug sales reportedly occurred between March 3 and April 12, and were made to an undercover officer from the narcotics unit of the Berrien County Sheriff’s Department.

At the time of these drug sales, it is alleged that Erhard knew he was selling marijuana to an individual whom he knew did not possess a medical marijuana card, as the undercover officer had informed him of that fact.

Members of the sheriff’s department and the Michigan State Police Southwest Enforcement Team executed search warrants Wednesday at the business and at Erhard’s residence. Additional charges may be forthcoming as a result of the execution of the search warrants.

Erhard said in an interview with the Star in March that at the 3M Center, “we require proper medical records. End of story; have a nice day.”

He said that in the four months his business was open, he was turning away more patients than he was able to verify, and he was booked 60 days out. Erhard claimed the center conducted voluntary 90-day follow-up appointments with patients.

“It is my responsibility to educate the community, whether it’s law enforcement or other doctors, so people don’t have to be scared,” Erhard said.

Erhard was present at the time of the execution of the search warrant at the business and was taken into custody by members of the narcotics unit.

A temporary retraining order was issued Wednesday by Berrien County Trail Judge John Dewane enjoining any further operation of Your 3M Medical Marijuana Center until a show cause hearing can be held before Dewane on April 21 at 3 p.m. The prosecutor’s office is seeking to permanently close the center as a public nuisance, given the illegal drug sales that were occurring at the location.

Erhard is expected to be arraigned today in Berrien County Trial Court in St. Joseph.
