Brothers will face future in prison

CASSOPOLIS — Two weeks after his brother received his sentence two weeks ago on methamphetamine-related charges, Timothy Turner faced his sentencing Friday at Cass County Circuit Court.

Based on his criminal record, Timothy Turner was handed a stricter sentence, ordered to serve a three- to 30-year prison term, compared to his brother getting two to 20 years. His brother was sentenced to two to 20 years.

Prosecutor Victor Fitz said it was Timothy’s fourth drug conviction and said it was clear he and his brother were “hot and heavy in meth activity.”

Judge Michael Dodge said the brothers’ meth activity was discovered March 1 when police were dispatched to their Marcellus home to respond to an altercation between the brothers.

The officers arrived to find the brother arguing outside the house and later found methamphetamine components. The brothers then admitted to having cooked meth at the residence and testified to doing so again under oath in court.

Defense attorney Nicholas Leydorf argued the brothers were producing the drug for personal use and were not selling it.

Also sentenced Friday:

• Clayton Warren, 21, of Marcellus, was sentenced to 90 days in jail with credit for 17 days served for resisting and obstructing a police officer and attempted felonious assault. The incident took place June 25 when he assaulted his friends with nunchucks. The assault took place after his friends attempted to calm an argument between Warren and some family members at a residence in Marcellus.

• Jeffrey Henry, 46, of Cassopolis, was sentenced to one year in jail with credit for 70 days served, instead of prison as recommended by the presentence report. Henry, who pleaded guilty to delivery and manufacture of marijuana, has an extensive criminal history, including serving 12 consecutive years in prison.

Henry said he had been living in a trailer without utilities and selling marijuana to make ends meet.
