Fisk sentenced to 24 months

GRAND RAPIDS - U.S. Attorney Margaret M. Chiara announced Monday that Allen Fisk, 45, of Marcellus, was sentenced by U.S. District Court Judge Robert Holmes Bell to a 24-month term of imprisonment, three years supervised release, a $3,000 fine, restitution of $20,917.16 and a special assessment of $100.
Fisk was convicted of defrauding customers by using his private accounting business to embezzle their tax refunds.
Fisk pleaded guilty to a charge of wire fraud in violation of Title 18, United States Code, Section 1343, on Sept. 8, 2005.
Fisk was serving as the publicly elected president of the Village of Marcellus at the time of the offense.
Attorneys for the Village of Marcellus had Fisk temporarily removed from his position pending the outcome of this case.
Fisk is also awaiting sentencing on state fraud charges filed in Cass County.
Chiara, a former Cass County prosecutor, expressed her appreciation Dec. 12 for the efforts of U.S. Secret Service Special Agent Shawn Smith and Assistant U.S. Attorney Michael A. MacDonald, who prosecuted this case on behalf of the United States of America.
