Niles City Police were dispatched to Broadway Avenue for a fight between a male and female on Monday night at approximately 11:00 p.m.
Upon arrival, the police were notified that the male had just left in a Chevy Tahoe.
Another officer spotted a Chevy Tahoe matching the description turning on to Miller Drive.
The vehicle was stopped for a traffic violation and was pulled over on Baldwin Drive.
The subject, Norman K. Lee, 32, of 629 Johnson St. in South Bend, Ind. exited the car and began walking toward the house he had pulled over in front of.
The officer yelled at Lee to stop so he could talk with him.
Lee initially ignored the command, but eventually turned to face the officer.
He instructed Lee to place his hands on the hood of the vehicle and then conducted a pat down for weapons.
The officer felt what he believed to be a handgun in a holster.
He immediately removed the gun and placed Lee in handcuffs.
Lee stated that he had an Indiana concealed weapons permit to carry the handgun.
According to the police report, the officer smelled intoxicants on his breath and asked him to submit to a preliminary breath test. The results of the PBT were .074.
He then advised Lee that he was being arrested for possession of a handgun while intoxicated.
After contacting the South Bend Police Department to check the status of Lee's concealed weapon permit, they learned that Lee had a permit which expired on Sept. 7, 2003 and was no longer valid.
He was charged with possession of a handgun while intoxicated.
