No charges filed after fatal Niles crash

The prosecutor’s office said Wednesday it will not file charges against two drivers involved in a fatal accident on the US-31 Bypass south of US-12 in Niles on Sept. 16.

Tanjela Williams, 22, of Benton Harbor, was the driver of a 1998 Toyota, traveling southbound in the passing lane when she encountered a bucket in the roadway that apparently became lodged under her car.

Williams stopped her car in the passing lane intending to dislodge the bucket. Before she could exit her car, a vehicle driving in the same lane, a 2012 Chevy Camaro driven by a 16-year-old, from New Carlisle, Indiana, crashed into the rear of Williams’s car.

Two children in Williams’ car died as a result of the accident — a 10-month old boy and a 4-year-old girl.

The prosecutor’s office said an investigation found that while the 16-year-old was speeding, she likely would not have had time to stop even if she was traveling at the posted speed limit of 70. she was going 81 miles per hour, according to the prosecutor’s office.

The prosecutor’s office also said the investigation found that the children in Williams’ vehicle were not restrained as required by law. In addition, the prosecutor’s office said Williams should not have stopped in the travel portion of the highway.

In a press release, the prosecutor’s office provided the following explanation for its decision to not press charges:

“Arguably there is equal fault in this tragedy; or, perhaps the negligence of Williams stopping on the highway and not assuring compliance with children’s safety belt requirements may outweigh the 16-year-old’s speeding. In that event, the horrible circumstances of Williams’ injuries, and the death of two occupants of her vehicle weigh against charging her with an offense.”

Both drivers will face driver’s bureau evaluations.
