A Buchanan man who had inappropriate sexual contact with a 13-year-old girl was sentenced to more than three years in the Michigan Department of Corrections.

Bernard Michael Blumka was crying and expressed remorse before Judge Dennis Wiley sentenced him to 42 months in prison Monday in Berrien County Trial Court in Niles.

“I apologize to everyone involved,” said Blumka, who pleaded guilty to one count of criminal sexual conduct in the second degree.

According to court documents, the incident occurred at the Buchanan apartment where Blumka was staying sometime around June 23 of this year.

“You are the adult, she is the child and you went well over that line,” Wiley said. “That type of behavior is not going to be tolerated in our society.”

Assistant Prosecutor Amy Byrd said the incident damaged the victim psychologically.

“She is worried it could happen again,” she said, adding that the victim is afraid to visit the homes of other people.

Blumka has no prior criminal record. Wiley said he gave Blumka credit for taking responsibility for his actions and not forcing the victim to relive the incident through a trial or other court proceedings.

Blumka was also ordered to undergo sex offender treatment while in prison.
