Prosecutor awaits police report on fatal crash

It is too soon to determine whether or not charges will be filed against a 14-year-old driver whose passenger died in a car crash early Tuesday morning.

Brandon Zachary Burr, of Niles, was traveling east on Bertrand Street in Milton Township when he lost control of the vehicle and struck a tree at around 2:05 a.m. The lone passenger, 12-year-old Andrian Chiquito, of Niles, was pronounced dead at the scene.

Victor Fitz, Cass County Prosecutor, said his office is awaiting reports from the Cass County Sheriff’s Department.

“Once those are compiled and forwarded to us we will assess them for any potential charges,” Fitz said. “We haven’t had an opportunity to review any reports so it would be too early to say.”

Fitz said he expects to receive more information from the sheriff’s department by sometime next week.

The prosecutor said he doesn’t know if the family of the boy who died in the crash wishes to pursue charges.

“We haven’t had direct contact with the family,” he said. “We will be in discussions with them when we receive the reports.”

Fitz said, without knowing the facts of the case, it would be premature for him to speculate as to what charges, if any, could be pursued.
