A Berrien Springs man is going to prison after verbally abusing a 10-year-old boy because the boy soiled his pants.

Ty Grant Black, 40, was sentenced to 14 months in the Michigan Department of Corrections by Judge Dennis Wiley Monday in Berrien County Trial Court. Black, who receives credit for 29 days served, pleaded guilty to attempted child abuse in the second degree.

According to court documents, the abuse took place between July 1 to Aug. 31 of this year at a Berrien Springs residence. The victim was the son of a woman Black was dating.

Police found a cell phone video of Black verbally abusing the 10-year-old boy, using profanity and threats due to the boy going to the bathroom in his underwear. Black was also observed pushing and poking the boy in the face, while holding a bottle of gin, according to court documents.

The victim’s father told the court prior to Black’s sentencing that his son is undergoing counseling.

“It may be something that follows him the rest of his life,” the father said.

Wiley handed out a sentence higher than the zero to 14 months sentence guideline.

“What was going on was one of the most reprehensible and disgusting situations I’ve come across,” Wiley said. “You had the audacity to take a 10-year-old boy with a serious problem and humiliate him on a continuum.”
