Sex offender faces deportation

A 22-year-old illegal immigrant is facing likely deportation after being convicted in Cass County Courts of having sex with a 14-year-old girl.
Luciano Martinez, who is listed as residing at 9070 Cushing Rd. in Eau Claire, was sentenced to a minimum of 40 months in the Michigan Department of Corrections Friday by Circuit Court Judge Michael Dodge.
Martinez pleaded guilty in May to two charges of criminal sexual conduct in the third degree for admittedly having oral sex and sexual intercourse with a minor at a hotel on Michigan Highway 51 in Dowagiac.
Martinez’s attorney, Dale Blunier, described his client as an immature 22-year-old man in a teenager’s body, who had never had a girlfriend prior to meeting the victim.
Prosecutor Victor Fitz said Martinez aggressively pursued a relationship with the victim against the wishes of the girl’s mother, even going so far as providing the girl with a cell phone so she could call Martinez.
Dodge said Martinez is in the country illegally and his felony conviction subjects him to deportation by federal immigration authorities.
Fitz said he is uncertain if Martinez would have to serve the prison sentence prior to being deported if immigration authorities decide to deport Martinez to Mexico.
Martinez is credited with 95 days served. Sentence guidelines were 36 to 60 months in prison.
