Silver Creek granted injunction

CASSOPOLIS — Cass County Circuit Judge Michael E. Dodge Monday morning signed an order for a preliminary injunction in Silver Creek Township’s lawsuit against the owner of White Pines Mobile Home Park on M-152.

Dodge’s order “restrains and enjoins” Joel E. Reinoehl of White Pigeon from pumping, dumping or allowing raw sewage to be discharged onto the ground, ditch or pond.

Dodge further ordered that if the septic system fails, which would result in discharge onto the ground, ditch or pond, the defendant shall cause raw sewage in septic tanks on the premises to be pumped and hauled by a properly licensed person to a licensed sewage disposal facility rather than being permitted to be unlawfully discharged.

Further, inspectors from the Van Buren-Cass County Health Department, represented by Public Health Sanitarian Brian Lint, may enter the premises and test and inspect the property at any time.

Silver Creek, represented by Supervisor Bill Saunders and Dowagiac attorney John Magyar, may file a contempt motion if Dodge’s order, which Reinoehl signed, is violated.
